I am going to court on ONE credit card debt. I cannot pay?

the minimum payment. I WAS going through a debt solution paying them so much every two weeks…But they KEPT taking out the money on wrong days….CUZ EVERY other week my payday falls on a different DATE. I reguested a refund….Also my bank kept charging me FEES which they REFUSED to pay..Anyway, I am LOW INCOME…THE DEBT is over $10,000.00. What will most likely happen in court? Only people that have DEALT with the court system please answer…THANK YOU!!

Find a bankruptcy lawyer and file for chapter 7 immediately.

You will need to go to financial counseling classes… but from what it looks like this would not hurt you a bit.

You knew on what days the payments were coming out of your account. What you do then is budget… that means leave enough money in the account from the previous pay check to cover that bill when they take it out…

The court hearing – You need to be there because although the judges do consider your financial situation they don’t “forgive” it just because you are low income… The creditor will get his judgement and if you don’t file for bankruptcy then they will garnish your wages (if it is allowed in your state) and they will take whatever money is in your bank accounts.

If you don’t show up then the creditors will be able to add even more in fees and attorney charges. Since you are not there to protest… they usually get what they want.
